These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing this website or purchasing any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services Provided

1BDM Agency offers branding, website design, content creation, and marketing strategy services. All services are delivered digitally and are customized based on the client’s selected package, scope, and goals.

A detailed service description, timeline, and deliverables will be provided upon project start. Any additional work requested beyond the agreed scope may result in additional charges.

2. Client Responsibilities

You agree to:

Provide accurate and timely information, content, and feedback necessary for service completion.
Respond to communications within a reasonable time.
Review and approve drafts or deliverables within agreed timelines.

Delays in feedback or approval may impact the delivery timeline and are not the responsibility of 1BDM Agency.

3. Payment Terms

We accept payments via Wix Payments, PayPal, and Stripe. Full or partial payment (depending on the package) is required upfront before services begin.

Failure to pay on time may result in delays or suspension of services. Payment plans, if applicable, will be outlined in your invoice or proposal.

4. Refunds, Cancellations & Rescheduling

Due to the personalized nature of our work:

Refunds: All sales are final once work has commenced. No refunds will be provided unless we cancel the project before work begins.
Cancellations: Projects cancelled before work begins may incur a 10% administrative fee.
Rescheduling: Any rescheduling of meetings or strategy calls requires at least 24 hours’ notice. Last-minute changes may incur a $25 rescheduling fee or forfeiture of the session.

5. Revisions & Edits

Each project includes a defined number of revisions (usually 1–2 rounds, depending on the service). Additional revisions beyond those included in your package may be billed separately.

6. Ownership & Intellectual Property

All original content created by 1BDM Agency remains our property until full payment is received.

Upon final payment:

You are granted full rights to use the final deliverables for business use.
We retain the right to showcase work for portfolio and promotional purposes unless otherwise agreed in writing.

Any stock images, fonts, or third-party content used remain subject to their respective licenses.

7. Third-Party Tools & Integrations

We may use third-party tools or platforms (e.g., Wix, Canva, Stripe, PayPal, Google Analytics) to deliver our services. We are not liable for downtime, bugs, policy changes, or failures of third-party platforms that affect project performance.

8. Limitation of Liability

To the fullest extent permitted by law:

We do not guarantee specific business outcomes (e.g., increased revenue, followers, or conversions).
We are not liable for indirect, incidental, or consequential damages, including data loss, delays, or interruptions caused by third-party platforms or client negligence.

9. Termination

We reserve the right to terminate a project or relationship at any time due to non-payment, breach of terms, or unprofessional conduct. Any unpaid work completed up to termination will be invoiced accordingly.

10. Governing Law

These Terms are governed by and construed under the laws of the State of Florida, USA. Any disputes shall be resolved in the courts located in Miami-Dade County, Florida.

11. Changes to These Terms

We may update these Terms at any time without prior notice. Updates will be posted on this page and become effective immediately.
